As a graduate of Embry-Riddle Aeronautical University with a Bachelor of Science in Aeronautical Science, Gregg Trautmann knows aviation. Mr. Trautmann is a commercial pilot having logged thousands of hours in many different types of planes. He is a certified flight instructor holding instrument and multi-engine instructor ratings. He also holds basic and advanced ground instructor ratings.

The vast majority of air crashes occur during general aviation flights as opposed to commercial airlines. These general aviation flights are usually privately owned and small aircraft being operated by low time pilots. Litigation involving any aviation accidents will focus on a number of possible causes.

Unlike commercial air carriers, private or general aviators are not required by federal law to maintain a heightened standard of care towards passengers. The law treats a general aviator much like the operator of a motor vehicle, requiring that the pilot use reasonable care to prevent accident or injury. Additionally different maintenance requirements are placed upon general aviation aircraft than are required of the airlines.

Even in cases where a general aviation pilot agrees to carry a fare-paying passenger, only the common rules of negligence and due care apply with respect to the maintenance and inspection of the aircraft. Like the standard for commercial pilots, the pilot of a private aircraft must still comport with the standards of care and expertise of the average, qualified pilot in the operation of the plane.

After any air crash, legal claims may involve for instance pilot error, faulty manufacture and maintenance, unsafe flying and weather conditions, defective onboard computers or software, or fuel tank explosions. Counsel must understand the availability and admissibility of NTSB reports and whether certain international treaties govern a particular case. Only attorneys having a thorough understanding of the law and rules governing aviation disasters can properly represent a client's interests. The challenges of proving the causation of an aircraft crash are usually complex problems requiring a high degree of expertise.
